Our terms and conditions together with our Privacy Policy constitute a legally binding agreement (Agreement) between you and Settio Property Experience Limited. Settio Property Experience Limited is a company registered in England and Wales (company number 11121857) whose registered office is at 3 Piccadilly Place, Manchester, M1 3BN (Settio, we, us, our) for use of the Services (as defined below). Your use of any Service [or your clicking “I Accept”, whichever is earlier,] constitutes your acceptance to this Agreement. 3. The information that we collect from you

3.1 We will collect any information that you provide to us directly when you register with us for use of the Service and when you use the Service generally. As property owners and tenants this information may include your name, email address, postal address, bank account details, telephone number, current and historic occupation and salaries. We will also collect any correspondence between you and us and any content you send or upload to us which may include copies of identity documents, bank statements and other forms of address proof and documents issued by HMRC.
3.2 Financial data maybe requested by our processors to complete the task to which you have directly instructed us to complete. We are the controllers of the processor and ensure this data is stored safely and securely. We may store bank details or direct debit orders which you have instructed directly for as long as necessary to complete the Service.
3.3 We may collect certain information about how you use the Service. This may include your IP address, geographical location, browser type, referral source and similar information. This information may be collected by a third-party website analytics service provider on our behalf and may be collected using cookies. 3.4 In some instances, we may receive some information that you submit to any third-party website that you access from a link available through the Service. Both us and the owner or operator of that third-party website will be the data controller in respect of any such information. 4.2 In addition to the specific uses set out in section 3 above, we may use your information for the following purposes:
4.2.1 to facilitate the contract between you and the relevant tenant or landlord
4.2.2 to process debit and credit card payments;
4.2.3 to verify your identity;
4.2.4 to prevent, detect and investigate potentially illegal activities;
4.2.5 to ensure that the Service is presented in the most effective manner;
4.2.6 to send you general (non-marketing) commercial communications, such as information about the Service;
4.2.7 to provide customer service in relation to your use of the Service, to contact you, to deal with enquiries and complaints relating to the use of the Service and to notify you of any changes to the Service;
4.2.8 to develop, improve and personalise the Service so as to improve your experience;
4.2.9 to provide third parties with anonymised statistical information about our users;
4.2.10 to provide you with marketing communications by post and/or electronic means (such as email, SMS and/or MMS) about our products, services, events and offers, which you have requested to be sent; and
4.2.11 to provide you with marketing communications by post and/or electronic means (such as email, SMS and/or MMS) about our other group companies’ and/or carefully selected third parties’ products, services, events, special discounts and offers where you have expressly consented to be contacted for such purposes.
4.2.12 to provide insurance companies with information to facilitate the purchase of insurance products on behalf of landlords.

5. Disclosure of your information

5.1 Other than as expressly set out in this privacy policy or as otherwise required or permitted by law, we will not share, sell or distribute any of the information you provide to us without your consent.
5.2 We may disclose your personal information to:
5.2.1 the relevant tenant and/or landlord who you contract with via the Service;
5.2.2 third parties who we use to verify your identity;
5.2.3 any third party to whom disclosure is necessary to enable us to provide the services or products which we offer through the Service; and
5.2.4 any person to whom disclosure is necessary to enable us to enforce our legal rights, or to protect the rights, property or safety of our employees or where such disclosure may be permitted or required by law.

6. Storage of data

6.1 Your data will be stored on our CRM systems to enable us to carry out the necessary steps to provide you with the service for which you enquired about or entered into a contract for. This data will be willingly provided to us by yourself. In some cases, we may get your information from a third party or partner company. This information would only be shared with us should you have provided the third party or partner company with prior consent to do so.
6.2 We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
6.3 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will retain your information for as long as is necessary to provide any services to you or for a reasonable period or as long as the law otherwise permits.

10.1 You are entitled to know what personal data we hold about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. In certain limited circumstances you may also be entitled to request that we delete certain information that we hold about you.

We are entitled by law to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you and we may also require you to provide us with appropriate identification before we comply with this request.
10.3 You may request that we cease sending you any marketing information at any time by notifying us in writing or following any “unsubscribe” instructions included in any marketing communications which we send to you.
10.4 We adhere to the guidelines set by GDPR legislation to state that you have the right to be informed, the right of access, the right to rectification, the right to erasure, the right to processing, the right to data portability, the right to object and the right not to be subject to automated decision-making including profiling.
